Terms and Conditions

 

1. INTRODUCTION

These Terms and Conditions govern the use of the Akin Flower Company website ("the Website") and the purchase of products from the Website. By accessing the Website and/or placing an order, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, you should not use the Website.

2. ORDERS AND CANCELLATIONS

1. Pricing and Payment

  • Prices shown on the Website are inclusive of VAT and delivery charges, unless otherwise stated.

  • We reserve the right to amend prices indicated on the Website at any time without notice.

  • Payment for orders can be made using Visa, Mastercard, American Express, China Union Pay, JCB, Diners, Discover, Electron, Maestro, Apple Pay and Google Pay, a secure payment gateway accepted on the Wix platform.

2. Product Description and Availability

  • We offer seasonal locally grown flowers for subscription or one-time purchase. Each product is subject to its description, and there will be variations due to the natural materials used.

  • All floral products are subject to availability. We reserve the right to substitute any product with an alternate product of similar value and quality.

3. Order Acceptance

  • All orders received are subject to acceptance by Akin Flower Company. We reserve the right to reject any order without giving reasons.

 

3. DELIVERY

1. Subscription flowers are delivered the first Friday after the date of purchase. Hand tied bouquets can be delivered on a day of your choosing. All orders need to be placed a minimum of 48 hours in advance of delivery date.

  • We currently deliver within a 7-mile radius. Further delivery options may be available upon discussion.

  • We will make every effort to deliver your order within the specified time frame. However, please note that circumstances beyond our control may affect delivery times.

  • If you are not available to receive the delivery and have provided a safe place for us to leave the order, we will not be liable for any loss or damage to the order once it has been delivered to the designated safe place.

3. Safe Place

  • It is the customer's responsibility to provide a safe and secure location for delivery. If no safe place is specified and the recipient is not available to receive the delivery, we will attempt to contact the customer to arrange an alternative delivery time. If no contact can be made, the order may be returned to us, and additional delivery charges may apply for re-delivery.

4. Delivery Instructions

  • Customers can provide specific delivery instructions during the checkout process. While we will make every effort to follow these instructions, we cannot guarantee that delivery instructions will be followed in all circumstances.

5. Cancellation Policy

  • Customers can cancel their order by contacting us as soon as possible. Orders cannot be cancelled once they have been dispatched.

 

4. SUBSCRIPTIONS

1. Subscription Service

  • We offer a subscription service for customers who wish to receive regular deliveries of locally grown flowers. By subscribing, customers agree to recurring billing on a [weekly/monthly] basis until the subscription is cancelled.

  • Subscriptions can be managed through the customer's account on the Website.

2. Subscription Changes and Cancellations

  • Customers can modify or cancel their subscription at any time through their account settings on the Website. Changes made after the billing date may apply to the following billing cycle.

 

5. RETURNS AND REFUNDS

1. Damage and Non-Delivery

  • If flowers arrive damaged or fail to arrive within a reasonable timeframe, customers should contact us for a replacement or refund.

2. Returns

  • Due to the perishable nature of flowers, we are unable to accept returns.

 

6. OFFERS AND PROMOTION CODES

1. Discount Offers

  • From time to time, we may offer products at discounted prices. These offers are valid from the time of introduction until the end date specified and cannot be used for purchases made before or after the offer period.

  • The use of promotion codes is subject to the terms and conditions specified for each code.

2. Special Offers

  • We reserve the right to offer personalised special offers and promotions. These offers are valid for the specified recipient only and cannot be transferred or redeemed by others.

3. Limitations

  • Only one promotion code may be used per order. Discounts are applied only to the bouquet cost and cannot be redeemed against delivery charges.

 

7. HAZARDOUS PLANT MATERIAL

  • Some flowers may be harmful or poisonous. Customers should be aware of the potential hazards associated with certain plants and handle them with care.

  • It is important to avoid contact with hazardous plant material, especially for children and animals.

8. WEATHER CONDITIONS

1. Adverse Weather

  • Akin Flower Company acknowledges that adverse weather conditions may impact the availability and delivery of products.

  • In the event of adverse weather conditions, including but not limited to heavy snow, ice, flooding, or high winds, Akin Flower Company may experience delays or disruptions in delivery services.

  • Akin Flower Company will make reasonable efforts to notify affected users of any delays or disruptions caused by adverse weather conditions.

2. Limitation of Liability

  • Akin Flower Company shall not be liable for any losses, damages, or liabilities arising directly or indirectly from adverse weather conditions, including delays or disruptions in delivery services.

  • Users acknowledge and agree that adverse weather conditions are beyond the reasonable control of Akin Flower Company and accept any associated risks or inconveniences.

 

9. FORCE MAJEURE

1. Effects of Force Majeure

  • Akin Flower Company shall not be liable for any failure or delay in performing its obligations under these Terms and Conditions if such failure or delay is caused by a Force Majeure Event.

  • Upon the occurrence of a Force Majeure Event, Akin Flower Company will make reasonable efforts to mitigate the effects of the event and resume normal operations as soon as possible.

  • In the event of a Force Majeure Event affecting the performance of Akin Flower Company's obligations under these Terms and Conditions, Akin Flower Company will notify affected users as soon as reasonably practicable.​
